Donation Agreement

The terms that apply to gifts to Foreningen Custorian, and the Danish law that governs public fundraising by non-profits like ours.

1. Who you're giving to

Foreningen Custorian is a Danish non-profit association (frivillig forening), CVR 46399455, registered in Odense. It owns and stewards the Custorian standard for children's digital safety. Under its statutes, the standard, the association's name, and its trademarks cannot be sold or exclusively licensed. Donations fund an organisation that is structurally independent of the platforms its standard assesses.

2. Legal basis and registration status

A public online donation appeal — a donate button, a MobilePay collection, or a public post asking for gifts — is an offentlig indsamling (public collection) under the Danish Collections Act (Indsamlingsloven), and must be registered with Indsamlingsnævnet before it goes live. Holding a CVR number does not exempt an association from this requirement.

Custorian's collection is filed under §3 of the Act (a single stated purpose, valid for approximately one year). The notification was submitted on 12 August 2026; a decision is pending. Once approved, this page will be updated with the registration number, the registration date, and the MobilePay MyShop (business) number declared on the registration.

3. How donations are used

Donations are used to fund our operations in service of our mission: protecting kids online. That means maintaining an open, auditable standard for children's digital safety and the independent tooling used to verify claims made against it — kept funded independently of the industry it grades, not commercial gain.

4. How to give

While the §3 registration is pending, there is no public donate button on custorian.org. If you would like to support the work now, email info@custorian.org for bank transfer details. Once the registration is approved, gifts will also be accepted via MobilePay MyShop (business), and this page will be updated accordingly.

5. No refunds

Donations are voluntary gifts. Once made, they are final and non-refundable, except where required by Danish law.

6. Tax deductibility

Donations to Custorian are not currently tax-deductible in Denmark. Approval under ligningslovens §8A requires, among other conditions, more than 100 donors per year each giving at least DKK 200. Custorian intends to apply for §8A status once that threshold is realistically in reach, not before. If and when §8A approval is granted, this page will say so and specify the applicable deduction limits.

7. Accounting and oversight

The collection is regulated by Indsamlingsnævnet under the Collections Act. Funds are held in a dedicated account, kept separate from Custorian's operating funds. Accounts for the collection are filed with Indsamlingsnævnet within six months of the collection's close. If total donations exceed DKK 50,000, the accounts are audited by a registered or state-authorised auditor (revisor); below that threshold, the nævnet's own reporting form is used.

8. Data protection

We collect only the donor data needed to process a gift and meet Danish bookkeeping-law obligations — typically name, contact details, amount, and date. Data is processed under GDPR, is never sold or shared with third parties, and is retained only as long as required under bogføringsloven (the Danish bookkeeping act) before deletion.
